November - RIP Eva Kipler

We lost one of our own this week.  Normally I don't try and censor, and probably never will again.  All I ask is that you be respectful when talking about Eva, and to each other when discussing her. We all deal with loss in our own way.

I will not delete or remove posts that don't follow what I've asked.  I just hope that you can show her the respect that she deserves.

RIP Eva Kipler.

I was able to briefly work with Eva on a project. I remember how sweet she was and kind. I wish the best for her family. The community lost a long standing and well respected member. She will be missed.

I'm shocked and saddened to learn of Eva's death. She was a great community member and digiscrap designer. My thoughts and prayers are with her family and friends during this difficult time.

Has anyone checked out TDF this month? What do you think of Mye de Leon's contribution? I am extremely disappointed in the preview. I am not sure how to use the papers since there doesn't appear to be anything else with them. They cry out for matching elements, not just stuff from my stash.

I am really disappointed, I got to the point I was going to cancel it and then they had two really decent months now it is dissappointment, to me the only thing good is Cindy S. Templates other than that it is a waste of money.

This month's TDF is awful. I don't even like Cindy's templates. I see nothing I'd waste time downloading.

Michelle Godin's is too dark.
Cindy's templates look like the same thing she puts out all the time. Nothing different at all.
Dawn by Design's color palette is cheap looking.
Amber Shaw's textures look fuzzy and weird.
Mye's preview is just the papers, but I assume there are elements. I don't like the colors.
Sausan's is a total waste.
Scotty Girl's papers look OK, but the elements are lacking (I understand that's the style, but it's not for me).
Just Jaimee's color palette is yuck, too. Maybe I'd feel differently if it were Spring, but it's not here.

SO has a FB Hop and TDC has a FB/Blog Hop. The SO one is fine, all coordinates with the other freebies they will have during DSD. I haven't had time to look at the TDC one yet.

TDC one is lame - nothing matches. DHD has one, but the site is beyond slow. Gennifer is probably too busy laughing at people with Kami to worry about site speed. Gingerscraps has one and it all matches. Gotta Pixel has one that starts tomorrow. Oscraps is supposed to have freebies tomorrow, but not sure if it's a hop or what.

MDL's TDF preview is just the papers but I opened up the first zip and it's the elements. I would have been really annoyed if it'd been just papers. Actually, I'm annoyed because her doodled paisley elements, stamp, and swirl1 are all jaggy. Those are the only elements I've looked at. I'm afraid to look at more right now. (And I love Mye's work, so I'm quite disappointed since she was the designer I was looking forward to most this month.)
And yes, I liked GS's train and the SO "Block Party." Hopefully I'll be able to participate in SO's challenges so I can get some more elements--I didn't like some of the packs on fb.

Probably because it's ugly as hell. I'm kicking myself (only lightly because it's only $5) for not cancelling my sub - usually i purchase after a few reveals then cancel the autobilling... forgot to last month! Would not have purchased any of this lot if I saw it in a store.

I think the suspicions were a bit understandable given the post made by her husband in the public forum. I thought it was unusual, too, but didn't think someone like Eva would fake something like that. Now, some other people, yes. I did find it odd her husband didn't know how to contact any of Eva's co-designers or Robin herself, though.

45 is young, but people die every day at all ages and she had children. It's important for both spouses and at least the person you've legally chosen as guardian of your children all know who to contact if something happens - whether you're 25 or 95.

I hope people take that away from this as well and put a plan in place. No matter how morbid you may think it, it needs to be done because any one of us could be gone tomorrow.

You don't know who he may have contacted at SSD before he made that post. Julie Billingsley knew it was a heart attack, so maybe he contacted her?

Maybe some good will come out of this sad moment of Eva passing away.
It will make you all think what will happen if suddenly I'm gone one day.
It's smart to have plans for worst case senario.You never know.

#2 I just saw the November Digi Files and I'm very disappointed. I wanted to cancel my subscription but thought that it's November and something good will come out but unfortunately it didn't.
I can't beleive how bad Michelle Godin's kit is.
And all the others are so blant and boring.
The only one that is ok is Just Jaimee's.

When my dad passed from his heart attach, I was the one who had to make all the calls etc. Its the hardest thing in the world to have do. Especially after someting so unexpected. I cant imagine if it were my husband. And lets face it- most men arent natural born communicators.

RE Digi Files: I wouldn't say that Sausan's is ugly...just not a very vibrant color palette and the colors look all washed out (so very boring to me and how I scrap). The grungy kit style doesn't help the washed-out feel. My gripe with Sausan's kit is the same as my gripe about Mye's: bad quality. Sausan's papers are blurry (and the elements that use papers are blurry, too.) Goodness, I wish the Daily Digi would contact me. I'd be their QCer. (Too bad this is an anon blog.)

But it's really annoying that I could easily see the problems that TDF people missed.) I mean, I don't mind if I don't like a color palette (I can recolor stuff), but I can't fix QC issues like blurriness.

I never found a month that had 7 hits but there are always 2 products that stand out,3 good ones and 2 ok, but this month it's 4 okays and 3 bad ones.

A question: Is the new FPP at myscrapbookart.com worth it? Did I read it correctly? It's $5.00 for 12 kits? That sounds like a good deal.

It's been my experience that it's somewhat commonplace to not receive an answer for designer/ct apps sometimes if you weren't picked. I personally don't agree with this practice but it's not uncommon at all.

KimB's got a great PU grab at SM but I haven't gotten around to purchasing it yet.

In terms of freebies, I like the SO Facebook hop; the STS one has some good parts and some total clunkers. Looking forward to seeing what the SM Facebook hop is like when it goes live tomorrow.

Ann, it's a cute store and I'm happy that you all were able to start fresh. Just a few tips:

The background is really....um....busy. Just mho.

And the gal that does the templates - Creatively Obsessed? - way too simple and plain. I'm pretty sure I could duplicate them in a few seconds.

But some of the kits are cute and there's a nice variety. Good luck to you and the other designers. Hope it all works out well :)

The owners of the store did all of the design of the store and the name. I have no control or input over that. Those of us that moved after BSS suddenly closed were just trying to find someplace to go to quick - or at least I was. I can't speak for everyone, but I suspect others did feel that way, too. It can take at least a month and often more to get accepted into another store. Continued harping over the name stuff that all happened before any of us signed on just punishes the designers even more. It's like we can't do anything right!!

With regards to me, I'm back in school full time and barely designing at all. There is no way that I could meet the requirements for any other store. The owners at BZ are nice enough to understand my situation and let me just do what I can. I guess I could of retired - and maybe I should of - but I do get stress relief from designing - or rather making things in Photoshop CS. And now I must go and write a C++ program that is due by midnight.

Just because a store doesn't meet someones idea of attractive doesn't mean there aren't nice products inside, and as for the bg shit, all they do is blow smoke out of their asses. Didn't I read back earlier where they allegedly tried to come across as legal against that new store because of the name? It's a name people, and bg doesn't own the rights legally or otherwise, if they did it would have been trademarked. Anyone can do a search for trademarks and clearly find out they don't have shit. Same as with their website, sure they own theirs, but any other domains that have any variation of their name, unless they buy them up, they don't have the right to them either. Personally, I commend Ann for coming here as herself and letting others know about her new store. isn't that what all of you do, advertise by posting links to stores, products, blogs etc? I see that as a form of advertisement, after all we all click and go see what the fuss is about, and you can't tell me once there, you don't look around at the store itself and see what is on sale, we all do. So why don't we agree to move on to something that actually has some beef behind it. Anyone familiar with Queen Brat? Script writer, kit maker, recently caught pirating.

I just downloaded some templates that were saved in both TIFF and PSD format. The TIFF files were over 40MB while the PSD files were just over 7MB. I resaved the TIFF files correctly and they are now only just over 2MB. Which means I deleted just 140MB and replaced with it just over 6MB. Sigh.

Bella Gypsy might not own a copyright or trademark on the name, but WOULD win in court by claiming a "service mark" on the trade name. Symbols of a company or business, in this case the Bella Gypsy logo constitute a "service mark", meaning that they are known for using that logo. Direct copy - which it was, not only with the name but to the logo itself (a slightly different font was used) was what the "new store" was trying to use, and did indeed try to claim the name Bella Gypsy for their store. In a closed market industry such as digiscrap, they would have indeed won any court case on that subject. So, #112, before you spout off again - read up on what you are talking about BEFORE you try telling others what's what.

For starters, whether or not you commend it has no relevance. Pimping goes against what this blog is about and I will not allow blatant pimping of stores or products.

This blog is here to discuss the scrap industry, it is not here as a marketing tool. If you want to market your stores or products, go to DST, DSA or MSA. Pay the fee and market to your hearts content.

Secondly, one look at that store is enough to make me close the browser tab and never go back there. A stores aesthetics represent the type of products and designers in that store. If a store is not aesthetically appealing, there is no way I would even look at any of the products in it.

For that matter, someone naming their kid Bella, or their dog Gypsy, or whatever, is infringing on their oh so lovely service name. Get a grip on reality, we designers and CT don't have a legal leg to stand on unless we have chucked out good money to copyright our product, license our name and trademark our product. And don't even get me started on state by state licensing for businesses, because as scrap stores go, they are a business, they earn money, but are they licensed? Of course not. So take your legalese back to where it came from and crawl back to your precious BG team.

I love SM but holy sh*t their DSD hop is a hot mess. Some are on Facebook, some are on blogs, some haven't posted, some have direct downloads, some kick you an off-site download service and you lose your place in the hop. Plus there's no unifying logo or icon on FB--big mistake.

Hopefully they'll do better when iNSD rolls around in the spring.

Sorry but unless you have a legal agreement between the font maker that the font is for your commercial use only, then you can't claim it's one companies or another's. Plain and simple. You should really look into what can be copyright/trademark legalities because you obviously don't know much. Much like, colors (and in some cases even color combinations) can't be trademarked or copyrighted because there are a limited number of color/color combinations.

Lord could you imagine if all the Jenn/Jen's went after each other about who used their name first?! Get over yourself. I'm tempted to start designing under the name GypsyBella just to piss ppl off.

A great example is there is a designer that goes by Design by Anita, and one that's Designs by Anita, and I believe even another that's Anita Designs. Should they all change their names, too?

If the designer in question did, in fact, change their name/logo, it was probably just to avoid a public scandal. Easier to just change your branding as a new designer than to fight an established one.

DHD's works well too.
SSD was missing a few last night. I haven't gone back to check it. But what was there was excellent!
TLP's is a mess because the designers don't link to the next one and I can't find the master list. (then again, I didn't look that hard.)

They changed their name to avoid further conflict, duh. Don't any of you morons know by now if something is similar, even accidental, that there is going to be some asshole somewhere who raises a stink about it? Smack about their store all you want. So it's similar, big deal. I love how everyone assumes it was an intentional "infringement". They changed their name as "demanded" by the BG team to keep from there being conflict, they did what was right and made their store different enough to stop confusion and so it wouldn't show up in the BG teams precious search results (yes the BG team whined about their search results in google showing something other than themselves). The owner of BZS fixed a place for the displaced designers of Charlys dual personality meltdown when she didn't have to. The bottom line here is you are looking for anything to bitch about, and you latch onto whatever tidbit floats your way, good or not. I like how so much is brought up that needs smacking, but you bypass it to pick on a store design and rehash old stories from a month ago. To me, that shows the same tired people who obviously are followers of certain people...you defend them enough. Besides, what shit you sling here, doesn't reach the mainstream of customers, hell, customers who are really serious about their digi scrapping just buy what they like, they don't care what a designer has done to their store design or who left what store, all they care about is getting decent product at decent prices. And btw, I thought this was a smack blog and no rules? I really like how the new owner likes to play all mighty on her new perch and dictate what should be said. IMO if you don't like how things are posted, then you shouldn't have steppws into Gennifer's shoes. Every link to every kit, every store you bring up as closing, every designer you bring up as moving to a new store, it is ALL a blatant form of advertising (Take A5D, closing, didn't we all run to shop and bitch how we couldn't bring up the site...duh advertising). I spent around $100 on Halloween sales and retiring sales and I plan on spending another $200 today. I started searching for the sales and looking up my wishlists. I also want to download the freebies from the blog hops. Busy day.

I said it last month and I'll say it again, Bella Gypsy and Bella Zingaro really aren't worth the smack time, especially since nothing new has come up since the last month.

Now onto DSD, I had a look at a few blog hops and so many were being conducted on FB. That didn't bother me, but some designers didn't have their gift up, while others didn't show what they were offering before you liked their page. Previews are a good idea.

1. Tradmarks are covered under common law in the US and do not have to be registered for legal protection. The continual use of a logo does offer protection.

2. A unique name or something that has little to do with the product itself is offered the most protection. The word scrapbook isn't trademarked just because a designer uses it. In the case of BGD, their name is unique to the industry and offers a brand reputation.

3. Some trademarks have absolution because of their registration. Disney would be an example of this type of registration. BGD would not but they would have protection within their industry of digital scrapbooking. It could be extended into paper scrapbooking as well.

4. Even if the "new" bella gypsy didn't know about the already existing BGD, that doesn't mean that BGD didn't have any legal rights. They were right to change their name because they more than likely would have lost in a lawsuit. So, they probably knew they couldn't win, and changed their name.
